          After hearing the learned counsel for the parties at some length and in view of the objection raised by the learned counsel for the respondents as to maintainability of the instant petition, both the parties have agreed for disposal of instant petition in the following terms:-

1.       That the petitioner will continue to seek remedy before the Election Tribunal where the election petition filed by the petitioner in respect of said controversy i.e. including recounting of the votes, is pending.

2.       That the Election Tribunal shall decide the election petition of the petitioner after notice to all concerned, where-after the petitioner will be at liberty to raise all objections and grounds, whereas, respondents shall also be at liberty to raise an objection as to maintainability of petition in accordance with law and relevant election rules.

          It is expected that petition may be decided within reasonable period of time, where after any aggrieved party shall be at liberty to seek further remedy as may be available in accordance with law before the proper forum.

          Instant petition stands disposed of in the aforesaid terms along with listed application.

          Let copy of this order may be communicated to the Election Tribunal i.e. II-Additional District and Sessions Judge, Khairpur for compliance.
