Petitioner and his Counsel called absent. No intimation received. Learned Asstt: A.G submits that instant petition is misconceived as the petitioner did not qualify in viva voce, whereas, appointment has been made strictly in accordance with law on merits. He referred to the comments filed on behalf of respondent No.3 particularly Para-4, which reads as follows:-

“It is prayed before this Hon’ble Court I have taken over the charge of office of DIGP on 03.10.2014, however report was called from SSP- Khairpur which reveals that petitioner passed in physical test as well as qualify written test by obtaining 25 marks & could not success to qualify the Viva-Voce test. (Such photocopy of results attached and marked as Annexure “A”).

It appears that in view of comments filed on behalf of respondent No.3, the petitioner has lost interest to proceed with instant matter. Accordingly, instant petition is dismissed for non-prosecution along with listed application.
