Learned Counsel for the petitioner pleads no instructions, however, submits that respondents may be directed to provide an opportunity to the petitioner before taking any adverse action against the petitioner. Learned State Counsel submits that instant petition is misconceived and is not maintainable as suspension order issued by the respondents to the petitioner, who is a civil servant, has been impugned through instant petition. While confronted with such position, learned Counsel for petitioner could not satisfactorily respond to such objection raised by the State Counsel. Moreover, the petitioner and his Counsel have not remained vigilant to proceed with the matter, which is pending since 2012 without any useful progress. We are not inclined to adjourn this matter any further. Accordingly, instant petition is dismissed for non-prosecution along with listed application. However, petitioner may be at liberty to seek remedy by approaching the appropriate forum, if still feels aggrieved by any such adverse action against him by the respondents, in accordance with law.
