                        Petitioners and their Counsel called absent, no intimation received. Through instant petition, the petitioners have contracted freewill marriage and sought protection and qaushment of F.I.R No. 58 of 2013 U/s 365-B, 34 PPC registered at police station, Surjani Town, District Orangi Town, Karachi regarding alleged abduction of Mst. Safdar Kanwal D/o Ghulam Akber. On 26.2.2013 the following order was passed:-

ASI Muhammad Sarwar I.O of Crime No.58/2013 Police Station  Surjani Town, Karachi present in Court submits that he will record the statement of petitioner No.1 (alleged abductee) and submit report in line of her statement within 03 days before concerned Magistrate. He is directed to do the needful and submit final report before learned Magistrate, who will pass appropriate order within 02 days under compliance report.

It appears that during investigation one of the accused namely Naeem-ul-Hassan S/o Mehmood-ul-Hassan @ Muhammad Ali was arrested and now he is confined in Central Prison, Karachi. Since the petitioner No.1 being sui-juris has affirmed her marriage with petitioner No.2. In view of above, we direct that said Naeem-ul-Hassan S/o Mehmood-ul-Hassan @ Muhammad Ali nominated in Crime No. 53/2013 of Police Station Surjani Town, Karachi be released subject to furnishing his PR bond in the sum of Rs.20,000/- to the satisfaction of jail authorities.

Copy of this order be facsimile to Superintendent, Central Prison, Karachi for information.           

 

                        Thereafter the matter has not been fixed in Court nor petitioners have come forward to proceed with the matter, it appears that the grievance of the petitioners has been redressed, therefore, they are not in attendance. Accordingly, instant petition stands disposed of along with listed application.
