Mr. Ghulam Shabir Dayo, advocate appearing in Criminal Jail Appeal No. 66/2012 on behalf of appellant Muhib s/o Muhbat Chachar, submits that as per his instructions, the appellant Muhib has already served out his sentence and has been released from the jail, he, therefore, does not want to press the instant criminal jail appeal.
Learned D.P.G does not oppose the dismissal of instant criminal jail appeal, however, subject to verification as to whether the appellant has actually served out his sentence and has been released from the jail.
Accordingly the instant criminal jail appeal is dismissed as not pressed, however, without reference to the submission of learned counsel for the appellant that the appellant Muhib has already served out his sentence in the instant crime and has been released from the jail. The disposal of instant jail appeal in the aforesaid terms will not affect the cases of other appellants in the same crime which will be decided on its own merits.
