It is contended by the learned counsel for the applicant, that the applicant is innocent who has been falsely implicated in Crime No. 99/2015 of P.S Sobhodero, District Khairpur, at the instance of police on the allegation of police encounter. Per learned counsel, in the F.I.R, it has been alleged that the applicant along with other co-accused persons resisted the arrest of accused persons nominated in another Crime No. 43/2015, registered at P.S Agra, whereas, no one received any injury out of such alleged police encounter. Per learned counsel, nothing has been recovered from the present applicant, whereas, there are no independent eye witnesses of the alleged incident, however, in order to drag the applicant along with other co-accused persons of same caste (Pitafi), the police has registered the false F.I.R. Per learned counsel, the applicant has no previous criminal record, whereas, the matter requires further inquiry, therefore, applicant may be enlarged on bail.
Learned D.P.G after perusal of the record, could not controvert such position.
We are of the opinion that the applicant has made out the case for further inquiry, as no specific role has been assigned to the applicant with alleged offence. Moreover, no recovery whatsoever has been effected from the applicant, whereas, no one has received any injury out of alleged police encounter.
Accordingly, the applicant Muhammad Hassan is granted bail on furnishing his solvent surety in the sum of Rs.50,000/- (Rupees fifty thousand) with P.R bond in the like amount to the satisfaction of the trial Court. However, the applicant shall attend the trial court regularly.
