Petitioner
and his counsel are called absent, no intimation received. Instant petition was
filed on 19.04.2013, whereby the petitioner has impugned detection bill
including arrears issued by SEPCO authorities. On 23.04.2013 when notices were
issued in the instant petition, the operation of impugned notice issued by NAB
authorities was suspended.
Today,
neither the petitioner nor his counsel is in attendance. Learned counsel for
SEPCO submits that the petitioner is defaulter and instead of approaching the
Electric Inspector has filed instant petition and has not paid outstanding
amount so far.
Since
the petitioner after obtaining restraining order from this Court on 23.04.2013 has
not remained vigilant to proceed with the matter, which is pending since 2013,
accordingly, this Court is left with no option but to dismiss instant petition,
which is hereby dismissed for non-prosecution along with listed application.
However, it may be observed that in respect of electricity dues, if any, the
SEPCO authorities can recover the same strictly in accordance with law, without
any interference of NAB authorities in the garb of voluntary return when there
is no Reference pending against the petitioner.
