Petitioners and their counsel called absent, no intimation received. Instant petition was filed on 02.04.2013 by the petitioners seeking quashment of FIR No.16/2013 registered under Sections 364, 34 PPC at police station, Baberloi, however, record shows that after having filed instant petition, the petitioners and their counsel never shown appearance except one date of hearing i.e. 03.04.2013 when notices were issued to the respondents.

Today, Syed Imdad Hussain Shah, respondent No.3 has shown appearance, who submits that the aforesaid FIR has been disposed of as the matter has been compromised between the parties. Be that as it may, since the petitioners and their counsel have not come forward to proceed with the matter, same is dismissed for non-prosecution.
