Petitioner
and his counsel called absent, no intimation received.
Instant petition was filed on 04.01.2012 whereby petitioner has sought
quashment of FIR No.45/2011 registered at PS, Agra on the ground that such FIR
is an afterthought as according to petitioner, the similar FIR was earlier
disposed of in “A” class.
Pursuant
to Court notice, statement has been filed on behalf of SHO, PS, Agra. Learned State Counsel submits that matter has already
been challaned.
It
appears that in view of such fact, the petitioner has lost interest to proceed
with the matter, whereas, instant petition is pending since 2012 without any
useful progress, as neither the petitioner nor his counsel is in attendance.
Accordingly, instant petition is dismissed for non-prosecution along with
listed application.
