          The appellant and his counsel called absent. No intimation received. Instant criminal acquittal appeal was filed on 26.11.2011 against the order of acquittal dated 01.11.2011 passed by the Additional Sessions Judge, Gambat in Sessions Case No. 832/2010, whereby the accused persons nominated in Crime No. 221/2010 registered at P.S Gambat were acquitted U/S 265-K Cr.P.C. It appears that instant criminal acquittal appeal was filed before learned Single Judge of this Court instead of Division Bench of this Court as required in terms of Chapter-III, Volume-V, Part B-2(iii) of High Court Rules and orders, therefore, on 24.02.2016, learned counsel for the appellant was directed to supply duplicate set thereafter office was directed to place the matter before Division Bench of this Court.

          Today neither the appellant nor his counsel is in attendance, nor the duplicate set as directed by this court has been supplied. Record further reveals that the appellant has not remained vigilant to proceed with the matter, which is pending since 2011 without any useful progress. Accordingly instant criminal acquittal appeal is dismissed for non-prosecution.
