          Learned counsel for the petitioners was directed to satisfy this court as to maintainability of instant petition in view of the relief sought in the prayer clause, as it appears that the relief sought through instant petition can be agitated before the Canal Officer/Executive Engineer, under the irrigation laws, in response to such query, learned counsel for the petitioners submits that the petitioners will not press instant petition and will approach the concerned authority under the irrigation law, however, requests that respondents may be directed to consider the request of the petitioners strictly in accordance with law and to pass appropriate order within reasonable period of time.

          Learned State counsel does not oppose the disposal of instant petition in the aforesaid terms.

          Accordingly, instant petition stands disposed of, however, the petitioners may approach the respondents under the Irrigation Laws to agitate their grievance whereas, such request of the petitioner shall be considered by the respondents strictly in accordance with law after providing an opportunity of being heard to all concerned, where after, appropriate orders may be passed preferably within a period of four weeks from the date when the petitioners may approach the respondents.

          Instant petition stands disposed of in the aforesaid terms along with list application.
