          Petitioner and his counsel called absent. No intimation received. Instant petition was filed on 18.05.2010, whereby the petitioner has impugned the order dated 29.05.2008 passed by Senior Civil Judge, Moro, on application U/O 7 Rule 11 C.P.C and also order dated 26.05.2009 passed by Additional District Judge, Moro, in Civil Revision No. 08/2008. Whereby the request of the petitioner for seeking rejection of plaint in F.C. Suit No. 35/2007 was declined. After having filed instant petition it appears that the petitioner has not remained vigilant to proceed with the matter, whereas after lapse of considerable time, it appears that the matter would have been proceeded and decided by the competent court of jurisdiction by now, as no restraining order has been passed by this court, therefore, the petitioner is not coming forward to proceed with the matter, which is pending since 2010 without useful progress.

          Accordingly, instant petition is dismissed for non prosecution along with listed application.
