Through
instant application, applicants seek protective bail in crime No.59/2015 of PS,
Kumb under Sections 376/2, 147, 148, 149 PPC. Learned
counsel submits that the applicants have been falsely implicated in the crime
due to enmity and applicants intend to surrender before the trial Court but due
to issuance of NBWs they could not surrender before the trial Court. He prays
for protection to approach the trial Court for appropriate relief.
Without touching merits of the case,
protective bail is granted to the applicants for seven days, subject to their furnishing
a solvent surety in the sum of Rs.25,000/- (twenty
five thousand) each and P.R. bond in the like amount to the satisfaction of the
Additional Registrar of this Court. Meanwhile operation of NBWs shall remain
suspended during above period. Protective bail shall cease to have any effect
on expiry of above period or when the applicants appear before the trial court
for seeking concession of bail, whichever is earlier.
Bail application stands disposed of along
with the listed applications.
