Through
instant application, the applicant seeks protective bail in crime No.08/2015 of
PS, Kumb under Sections 324, 353, 427, 148, 149 PPC
3/4 Exp. & 7 ATA. Learned counsel for applicant submits that applicant has
been falsely implicated in the crime due to enmity and applicant intends to
surrender before the trial Court but due to issuance of NBWs he could not
surrender before the trial Court. He prays for protection to approach the trial
Court for appropriate relief.
Without touching merits of the case,
protective bail is granted to the applicant for five days, subject to his furnishing
a solvent surety in the sum of Rs.30,000/- (thirty thousand)
and P.R. bond in the like amount to the satisfaction of the Additional
Registrar of this Court. Meanwhile operation of NBWs shall remain suspended
during above period. Protective bail shall cease to have any effect on expiry
of above period or when the applicant appears before the trial court for
seeking concession of bail, whichever is earlier.
Bail application stands disposed of
along with the listed applications.
