Learned counsel for the petitioner pleads no instructions and submits that the petitioner is not in contact since last several years. Instant petition was filed on 09.03.2013, whereby, the petitioner has prayed for directions of this Court to the respondents in respect of some outstanding amount. Instant petition otherwise appears to be misconceived as the contractual obligation cannot be enforced by filing petition.

Since, the petitioner and his counsel are not coming forward to proceed with the matter for the last several years, it appears that the petitioner has lost interest to proceed with the matter. Accordingly, instant petition is dismissed for non-prosecution.
