The applicant and his counsel called absent, no intimation received. Learned Deputy Prosecutor General submits that the instant criminal transfer application is pending since 16.07.2014 whereas, baseless allegations have been levelled against the Presiding Officer. It has been noted that after filing instant criminal transfer application, the applicant and his counsel have not remained vigilant and did not proceed with the matter with due diligence and sought adjournments.

It may be observed that seeking transfer of case from one Court to other in terms of section 526 Cr.P.C, reasonable grounds are required to be raised, whereas, such transfer cannot be sought on baseless false allegations against Presiding Officer, which amounts to showing no confidence in the district judiciary. Instant matter is pending since 2014 without any useful progress, whereas, it appears that the instant transfer application was filed with an attempt to prolong the trial, whereas, the applicant has lost interested to proceed with the matter, which is hereby dismissed for non-prosecution along with the listed application.

However, the learned trial Court shall proceed with the matter regularly without being prejudiced from filing of instant application, and dispose of the same within a reasonable period of time, in accordance with law.
