Through
instant petition, the petitioner appearing in person, has impugned the order
dated 08.03.2010 passed by 2nd Civil Judge & Judicial
Magistrate, Rohri, whereby, the final report
No.05/2010 submitted in crime No.106/2009 registered at police station, Kandhra, has been approved to be disposed of under “C”
class.
The
petitioner was directed to satisfy this Court as to maintainability of instant
petition on the point of laches and was further directed to point out any error
or illegality in the impugned order. However, the petitioner has not been able
to assist this Court either on facts or on law. He could not explain as to why
he lodged the aforesaid FIR after a delay of about one year and 08 months, from
the date of incident nor has explained to this Court as to why the aforesaid
order was not challenged before competent Court of jurisdiction, during all
these years. He has not been able to produce any incriminating material, which
may otherwise require this Court even to examine the request of the petitioner,
at this stage, to set aside the impugned order passed by the Magistrate, on a
report submitted under Section 173 Cr.P.C.
Accordingly,
instant petition being hopelessly barred by limitation is dismissed in limine
along with listed applications.
