            Petitioner and his counsel called absent, no intimation received. Instant petition was filed on 21.12.2012, whereby petitioner No.1 Mst. Amina d/o Allah Bux Memon has contracted freewill marriage with petitioner No.2 Faiz Muhammad s/o Manzoor Ahmed Mirani, sought quashment of FIR No.239/2012 registered at PS, Ubauro regarding her abduction. Petitioners appeared in Court along with their counsel on 26.12.2012 when notices were issued to the respondents and the IO in the aforesaid FIR with directions to the police to provide protection to the petitioners in respect of their freewill marriage, whereas, IO of FIR No.239/2012 was directed not to arrest anyone nominated in the aforesaid FIR till next date of hearing. However, thereafter matter was not fixed in Court nor the petitioners and their counsel came forward to proceed with the matter, which is pending since 2012 without any useful purpose. It appears that the grievance of the petitioners is already redressed and the aforesaid FIR has been disposed of in view of statement of petitioner No.1 Mst. Amina by the concerned Magistrate, therefore, the petitioners have not come forward to proceed with the matter.

 

            Accordingly, we dispose of the instant petition along with listed application, however, with direction to the concerned police to provide protection to the petitioners in respect of their freewill marriage and in case the aforesaid FIR has not so far been disposed of, the concerned IO shall ensure that statement of Mst. Amina has been recorded and the report may be furnished before concerned Magistrate along with order passed by this Court on 26.12.2012 for disposal of the case in accordance with law.
