2&3. It is, inter alia, contended by the learned
counsel for petitioner that a plot No.E-04 admeasuring 698.66 sq. yards in
Sindh Small Industries Corporation (SSIC) Sukkur was allotted in the name of
petitioner vide allotment order dated 22.11.2013 whereafter a lease was
executed between the petitioner and the SSIC on 28.04.2014 and since then the
petitioner is in possession and made construction, however, vide impugned
letter dated 04.08.2015 issued by Regional Director, SSIC, Sukkur, the
provisional allotment dated 22.11.2013 has been cancelled. Per learned counsel
for the petitioner, after registered lease deed in respect of aforesaid plot
the impugned letter for cancellation of such allotment is without lawful
authority.
From
perusal of impugned letter it appears that it has been alleged that there is no
industrial plot of ‘E’ category in SITE Sukkur, whereas, the said plot was
allotted illegally without seeking approval of the competent authority. Be that
as it may, it appears that provisional allotment in the name of petitioner and
subsequent execution of registered lease deed is not denied.
Let
pre-admission notice be issued to the respondents as well as Additional
Advocate General for 07.10.2015, when
comments shall be filed. In the meanwhile, no adverse inference may be drawn pursuant
to impugned order dated 04.08.2015 available at page 53 as annexure “F”, against
the petitioner, till next date of hearing.
