1                      Urgency application is allowed.

 

2                      Granted, subject to all just exception.

 

3                      It is, inter-alia, contended by learned Counsel for the applicants that the applicants, who are real brothers, have been falsely implicated in Crime No.43 of 2015 registered at Police Station, Jhangro at the instance of one Mansoor Katpar with whom a civil dispute regarding land  is pending before the Civil Courts. Per learned Counsel, section relating to Anti-Terrorism Act has been included in F.I.R malafidely, whereas, neither such incidence took place nor the provisions of Anti-Terrorism Act are otherwise attracted, however, in order to cause humiliation to the applicants and their family, the aforesaid false F.I.R has been got registered. Per learned Counsel, the applicants are willing to associate with the investigation and to surrender before the learned trial Court, provided they are granted protective bail for a period of seven days enabling them to approach the trial Court for obtaining pre-arrest bail in accordance with law.

 

 

                        Without touching the merits of the case, both the applicants namely Ghulam @ Dado @ Ghulam Hyder and Sher Ali both sons of Niaz Muhammad are admitted to protective bail in Crime No.43/2015 P.S Jhangro, District Sukkur, for a period of 07 days to enable them to surrender themselves before the concerned Court, subject to their furnishing solvent surety in the sum of Rs.25,000/- (Twenty Five Thousand) each and PR bond in the like amount to the satisfaction of Incharge Additional Registrar of this Court. This order shall cease to have its effect on expiry of the 07 days or on appearance of applicants before the concerned Court, whichever is earlier. If the applicants fail to surrender before the trial Court within stipulated period the surety amount of the applicants shall stands forfeited.

 

                        Bail application stands disposed of in the above terms.
