appearance, whereas, Vakalatnama has been filed on
their behalf of Miss. Nadia Ghouri, Advocate, which
is takenon record.

Abdul Rehman Bhutto, I.O Crime No. 230 of 2015 Police
Station, Pano Akil is
present in Court and submits that after recording statement of Mst. Faiza Bibi
D/o Muhammad Hanif U/s 164, Cr.P.C
before the concerned Magistrate, the report has been submitted before the trial
Court for disposal in cancelled “C” class after approval, however, final order
has not been passed by learned Magistrate.
Learned
Counsel for petitioner submits that matter may be disposed of by directing the
concerned Magistrate to pass order on the report submitted by the police for
disposal of Crime No. 230 of 2015 U/s 365-B, P.P.C at
Police Station, Pano Akil.
Accordingly,
instant petition is disposed of with direction to the concerned I.O to approach
the Magistrate who shall pass appropriate order on the report submitted in the
aforesaid crime for disposal of the same under “C” class, whereafter
compliance report may be submitted to this Court after one week of the receipt
of this order. The concerned police is also directed
to ensure that no harassment shall be caused to the petitioners in respect of
their marriage, whereas, protection may be provided to them in accordance with
law. Mst. Faiza Bibi D/o Muhammad Hanif, has
expressed her desire to go with her husband petitioner No.2 namely Muhammad Fasil S/o Faiz Muhamad, Jalali, she is at liberty to go with her
husband and also pass her life as per her own choice.
Petition
stands disposed of in the above terms.
