                        Instant matters are pending since 2012, whereas, it has been informed that the applicants/accused are attending the trial Court regularly  and have not misused the concession of interim pre-arrest bail and the bail after arrest granted to the applicants/accused in above cases. It has been further informed that trial is proceeding wherein three prosecution witnesses have been examined.

 

                        While confronted with the above position, and after hearing the learned Counsel for the parties at some length, the above bail matters are disposed of by consent by confirming interim pre-arrest bail granted to applicants/accused namely Moulvi Khadim Hussain and  Zulfiqar Ali alias Bhutto in terms of  order dated 13.2.2012 & 03.5.2012.

 

                        Whereas, learned Counsel for applicant/complainant does not press Criminal Miscellaneous Application No.S- 246/2012, which is disposed of, however with direction to the learned trial Court to conclude the trial preferably within a period of three months.

 

                         However, it is clarified that if the applicants/accused misused the concession of pre-arrest bail, the trial Court is at liberty to pass appropriate orders against them in accordance with law.
