Petitioners and their counsel called absent, no intimation received. Through instant petition, the petitioners have alleged harassment by the police officials, who according to the petitioners are creating hindrance in their lawful business of transport of the petitioners and demanding illegal gratification.

Notices were issued, pursuant to which comments have been filed on behalf of respondents, wherein the allegations have been specifically denied. It has been further stated that petitioners in order to pre-emptor avoid any legal action against them by the private respondents pursuant to non-performance of contractual obligation, have filed instant frivolous petition, by impleading the official respondents as party to justify the maintainability of instant petition. It appears that in in view of comments filed on behalf of official respondents, the petitioners have nothing to offer in explanation and have not come forward to proceed with the matter which is pending since the year, 2012 without any useful progress.

Accordingly, instant petition, besides being devoid of any merits, is hereby dismissed along with listed application for non-prosecution.
