Through instant
petition, the petitioner Muhammad Ramzan has prayed
that respondents may be directed to grant him mining permit/license of subject
land. However, nothing has been placed on record which may justify such claim
of petitioner. While the petitioner was confronted as to maintainability of
instant petition, he could not satisfy the Court with regard to his claim
seeking permit or License Lease License for Mining purposes.
Learned Asstt: A.G submits that similar request of the petitioner
was declined by this Court vide order dated 03.3.1998 passed in C.P.No.D-
889 of 1994 which was earlier filed by the petitioner for similar relief.
Learned Asstt: A.G submits that instant petition is
misconceived hence the petitioner may be directed to approach the concerned
authorities for grant of Mining Lease, who may consider the case of the
petitioner in accordance with law.
Since the petitioner
appears to be an illiterate person of advance age, Mr. Ghulam
Shabbir Shar, Advocate
present in Court, has candidly offered his probono
services to guide the petitioner in respect of his claim. Accordingly, instant petition
being misconceived is dismissed. However, the petitioner is at liberty to
approach the Secretary, Mines and Minerals, Government of Sindh, in respect of
his claim which may be considered in accordance with law, rules and as per the
policy if any, and appropriate orders may be passed thereon.
