Pursuant to Court notice, Ather Hussain, Mukhtiarkar (Revenue), Taluka Rohri shown appearance and submits that the petitioner is not employed with the respondents either on temporary or permanent basis and his temporary appointment expired after extension on 30.6.2010. He further states that presently there is no post lying vacant either on temporary or permanent basis in his office, he has however, stated that as and when such post lies vacant, the petitioner will be considered sympathetically.

Learned Counsel for petitioner submits that presently the Deputy Commissioner, Sukkur has advertised for appointment on certain menial posts, hence requests that Deputy Commissioner, Sukkur may also be directed to consider the request of petitioner for his appointment in any of such posts. Accordingly, instant petition is disposed of with direction to the petitioner to apply for such appointment on the basis of advertisement, which according to learned Counsel for the petitioner has been published in the Newspaper on behalf of Deputy Commissioner, Sukkur, who shall consider the request of the petitioner for his appointment sympathetically in accordance with law, whereas, Ather Hussain, Mukhtiarkar (Revenue) Rohri may also consider the request of petitioner for his appointment either on temporary basis or permanent basis, if any menial post lies vacant in his office.

Petition stands disposed of in the above terms.
