                        After hearing the learned counsel for the parties at some length, by consent, both these petitions are being disposed of in the following terms:-

(i)                The termination letter bearing No.Admn/SALU/KHP/-950 dated 25.2.2016 issued by Registrar, Shah Abdul Latif University, Khairpur in respect of petitioner stands set-aside.

 

(ii)             The petitioner will be given final opportunity of being heard and to furnish his reply before the Inquiry Committee as constituted by the Vice Chancellor, Shah Abdul Latif University, Khairpur and to cross-examine the witnesses, if petitioner may so desire, who have already been examined by the Inquiry Committee, whereafter, the Inquiry Committee shall conclude the inquiry proceedings strictly in accordance with law provisions of SALU Act and the rules in force, and shall forward the recommendations to the Syndicate for further orders.

 

(iii)           Such exercise shall be completed within two weeks from the final date of hearing, which may be given to the petitioner to appear before the Inquiry Committee, whereas, next date is fixed by consent as 16.5.2016 at 11:00 a.m in the meeting Hall at the Main Campus of Shah Abdul Latif University, Khairpur Mir’s, whereas, such period shall not exceed            One Month from the date of this order. In case of any adverse order, petitioner will be at liberty to seek remedy as provided under the relevant Statute and the rules framed thereunder in accordance with law.

 

(iv)           During Inquiry proceedings against the petitioner, petitioner will not carry-out any substantial functions pursuant to his appointment Order bearing No.ADMN/SALU/KHP/4925 dated 28.8.2015 as he is already under suspension, whereas, respondent will ensure that, during pendency of inquiry against petitioner, if they intend to proceed further in respect of subject Project i.e Strengthening of Academic Facility in Shah Abdul Latif University, Khairpur, legal course shall be adopted as per relevant law and rules of Shah Abdul Latif University, Khairpur.

 

                        Both the above petitions stand disposed of in the aforesaid terms along with listed applications.
