Petitioner
and his Counsel called absent, no intimation received. Through instant petition, the petitioner has
alleged that the respondent No.7 & 8 are selling Wine in the locality which
is thickly populated by Muslims, in violation of Excise Rules, and it has been
prayed that the official respondents and the area police may be directed to
take legal action against respondents No.7 & 8. It has been further prayed
that the official respondents may be directed to ensure that no such illegal
business of manufacturing or selling of liquor be allowed to be carried-out.
Notices
were issued, pursuant to which comments have been filed on behalf of respondent
No.6, wherein it has been stated that the respondents No.7 & 8 are neither
authorized dealers nor license holders to carry-out the business of
manufacturing or selling liquor, whereas, no complaint of the residents of the
area has ever been received in this regard.
Learned
State Counsel submits that as per comments filed by respondent No.2, 4 & 6,
they have denied such allegations, whereas, it has been stated that strict
legal action will be taken against such persons who will indulged in illegal
business of manufacturing and selling of liquor in the open market in violation
of law. It has been submitted that instant petition may be disposed of in view
of the assurance given by official respondents.
Accordingly, we dispose of this petition, with direction to the
respondents No.2 to 6 to ensure that no one shall be allowed to carry-out the
illegal business of manufacturing and selling of liquor in violation of
Prohibition (Enforcement of Hadd) Order, 1979 and
rules framed thereunder.
