Learned
counsel for respondent No.5 has placed on record the paid copy of SEPCO bill
for the month of October, 2015, whereby an amount of Rs.5,08,267/- has been
paid. Learned counsel for the respondent No.5 submits that instant petition is
not maintainable as the same has been filed directly by petitioner without
filing any objection before the Returning Officer or any appeal before the
Appellate Authority, as provided under the law, however, has paid the aforesaid
bill, which is issued in the name of his father, whereas, neither respondent
No.5 nor his father is defaulter.
Be
that as it may, since learned Addl. A. G. and learned DAG, in view of
hereinabove position support the contention of learned counsel for the
respondent No.5 and submit that instant petition is misconceived.
While
confronted with the above position, learned counsel for the petitioner could
not satisfy this Court, accordingly, instant petition is dismissed along with
listed application.
