Through instant petitions, the
petitioners have impugned the order (s) passed by the Returning Officers as
well as Appellate Authority, whereby nomination of petitioners have been
rejected on the ground that the proposer and seconder do not belong to same
Ward or did not appear before Returning Officer at the time of scrutiny.
Since similar controversy is involved
in all the above petitions, therefore, by this common order, we intend to
dispose of all the petitions.
We have heard learned counsel for the
parties as well as AAG and DAG and perused the record.
From perusal of record it appears
that the petitioners could neither prove before the Returning Officer nor the
Appellate Authority the fact that proposer and seconder belong to same Ward or
their appearance before the Returning Officer at the time of scrutiny and have
also failed to produce any material to show that the Proposer and Seconder
belong to same Ward. Prima facie, the impugned order (s) passed by the
Returning Officer and the Appellate Authority do not suffer from any error or
illegality. Accordingly, instant petitions being misconceived are dismissed.
However, the petitioners are at liberty to file appropriate proceedings before
the proper forum, if provided under the law, with regard to their eligibility.
