Petitioners
and their counsel called absent, no intimation
received. Instant petition was filed on 05.09.2013 by the petitioners seeking
quashment of FIR No.125/2013 registered at PS Kumb,
District Khairpur, under Section 365-B/34 PPC on the
allegation of abduction of petitioner No.2 Mst. Mirzadi, for being false and frivolous.
Petitioners
shown appearance along with their counsel on 05.09.2013 before this Court and
stated that the aforesaid FIR is liable to be quashed as the petitioner No.2 Mst. Mirzadi being sui juris has contracted freewill marriage without any pressure
and coercion with petitioner No.1 Aijaz Ali and has
not been abducted by anyone.
Notices
were issued to the respondents, whereas, restraining order was passed directing
the concerned police not to arrest anyone nominated in the aforesaid FIR,
however, it appears that thereafter the matter could not be fixed in Court and
is pending without any useful progress.
Today,
petitioners and their counsel are not in attendance nor they have remained
vigilant to proceed with the matter during all these years. it appears that the
grievance of the petitioners has been redressed and the aforesaid FIR is
disposed of by the concerned Magistrate for being false, therefore, the
petitioners have not come forward to pursue instant petition, however, we
dispose of instant petition with directions to the concerned police to ensure
that necessary protection may be provided to the petitioners in respect of
their freewill marriage as and when required, strictly in accordance with law,
whereas, in case aforesaid FIR has not so far been disposed of, concerned
IO/SHO shall ensure that aforesaid FIR may be got disposed of after recording
statement of petitioner No.2 Mst.Mirzadi and to place
the same before the concerned Magistrate along with order passed by this Court
on 05.09.2013, who shall pass appropriate orders in accordance with law.
Petition
stands disposed of along with listed application.
