have been filed on behalf of respondent No.3, which are taken on record and
copy supplied to the petitioner.
Instant
petition appears to be misconceived in facts and law as petitioner has impugned
order dated 17.06.2013 passed by respondent No.3 whereby the transfer and
posting order issued vide letter dated 27.05.2013 in his favour was cancelled.
Matter relates to terms and conditions of service whereas transfer and posting,
unless found to be based on mala fides, cannot be challenged by filing
Constitutional Petition before this Court. However, the petitioner present in
person, who statedly suffers from various diseases and is performing his duties
on detailment as HST at Government Murad High School, Gambat may approach the
District Education Officer, Khairpur for seeking his permanent posting.
Accordingly, we will dispose of
instant petition along with the listed application, with directions to
concerned District Education Officer, Khairpur, to consider the request of the
petitioner in accordance with law and pass appropriate orders thereon.
