3&4.               Through instant petition, the petitioner seeks re-investigation of FIR No.86/2015 registered at police station, Wasti Jiwan Shah, District Ghotki, against the accused persons nominated therein under Sections 324, 353, 148, 149 PPC on the ground that the police has falsely implicated the above persons in the aforesaid crime as mother of one of the accused persons had filed application under Section 491 Cr.P.C regarding their illegal detention by the police and in order to save their skin the police has falsely implicated the above persons in the aforesaid FIR. On a query of this Court, learned counsel for the petitioner submits that criminal miscellaneous application No.380/2015 is still pending before this Court and is fixed for hearing on 27.08.2015 wherein the police after notice did not show the arrest of aforesaid accused persons or registration of any case against them. However, on 02.08.2015 instant FIR has been registered to frustrate the application filed under Section 491 Cr.P.C.

 

            We are of the view that instead of filing the instant petition, petitioner may point out such facts in the aforesaid criminal miscellaneous application where such request of the petitioner for re-investigation into the matter may be considered. While confronted with this position, learned counsel submits that he would not press instant petition and make such request in the aforesaid criminal miscellaneous application on the next date of hearing. Accordingly, instant petition is dismissed as not pressed.
