Pursuant
to Court notice, Mr. Nisar Ahmed Mallah,
Advocate shown appearance on behalf of respondents No.1 to 3 and submits that
instant petition has been filed by concealing certain facts, whereas,
petitioners are defaulters of huge amount of electricity dues. It has been
further stated that direct connections are taken and petitioners instead of
making payment of their electricity dues, have approached this Court and
obtained interim order which is operative since 2013.
Learned Counsel for the
petitioner has denied such allegations and submits that the petitioners are
making regular payment of their electricity dues, whereas, their complaint is
pending before Electric Inspector, Sukkur. It appears
that seriously disputed facts have been agitated through instant petition,
whereas the petitioners have remedy as provided under the Electricity Act by
approaching the Electric Inspector for resolution of their dispute relating to
excessive electricity bills. Accordingly to learned Counsel for petitioners,
complaint has already been filed before the Electric Inspector. However, per
learned Counsel, it has been stated that Electric Inspector has not yet decided
such complaint. Accordingly, we are disposing of instant petition with
direction to petitioner to seek remedy as provided under Electricity Act,
whereas, in case any application filed by petitioner is pending disposal before
the Electric Inspector, the same shall be decided within 15 days of the receipt
of this order after providing an opportunity. The SEPCO authorities are at
liberty to take appropriate action for the recovery of electricity bills in
accordance with law and to disconnect such connections which according to
petitioners have been granted in violation of Electricity Act, by providing an
opportunity of being heard to the petitioners.
Petition
stands disposed of in above terms.
