                        Pursuant to Court notice, Inspector Rab Nawaz Rajper, SHO and ASI Ghulam Safdar Bozdar I.O of PS Dad Laghari shown appearance, whereas, statement has been filed on behalf of SHO, PS, Dad Laghari wherein it has been stated that challan No.30 RC No.128 dated 16.11.2015 has been submitted before 1st Civil Judge & Judicial Magistrate, Mirpur Mathelo by the concerned IO.

 

            Learned counsel for the petitioner submits that the respondents deliberately avoided to attend the Court in spite of specific directions as contained in its orders dated 10.11.2015, 19.11.2015 and 24.11.2015 as they were bent upon to charge-sheet the accused persons in the above false case and submit challan so that purpose of filing instant petition may be defeated.

 

            Today, the SHO, PS, Dad Laghari and the IO of FIR No.52/2015 have shown appearance in Court, however, did not file any explanation for non-compliance of the Court’s orders as referred to hereinabove, which reflects upon their mala fide and deliberate avoidance to appear before the Court in spite of repeated notices and specific directions to appear in Court. In view of hereinabove facts and the conduct of both the police officials, we would direct the SSP, Ghotki to conduct an inquiry in this regard and to take appropriate action against the delinquent officers in accordance with law, whereafter, compliance report may be submitted to this Court within 15 days through I/c Additional Registrar of this Court.

 

            Since challan has been submitted before the trial Court, we would not examine the merits of the case at this stage, however, the petitioner is at liberty to file appropriate proceedings before the learned trial Court or forum as available under law for redressal of his grievance as per law.

 

Petition stands disposed of in the above terms.
