Petitioner and his Counsel called absent, no intimation received. Through instant petition, the petitioner has impugned the order dated 18.12.2015 passed by Election Tribunal/ District & Sessions Judge, Naushahro Feroze in Election Petition No.175 of 2015, whereby the appeal filed by the petitioner has been dismissed in the following terms:-

“The careful perusal of impugned order and record shows that the loan amount of Rs.543244/- is outstanding against the deceased father of respondent No.1 and there are other legal heirs of the deceased father of the respondent No.1, the total outstanding amount against the legal heirs of the deceased father of respondent No.1, is not above Rs.One Million so that disabling provision of Section 99(i) of Representative Act 1976 comes in the way of respondent No.1/Candidate, therefore, in view of the case laws, the impugned order is hereby maintained, and the appeal in hand is hereby rejected accordingly.”

We do not find any error in the impugned order passed by learned Election Tribunal/ District & Sessions Judge, Naushahro Feroze, which depicts correct legal position. Accordingly, instant petition having no substance is dismissed along with listed applications.
