Pursuant
to Court directions, ASI Shahmir Solangi
of Police Station Qamaruddin district Naushehro Feroze has shown
appearance and has recorded statement of Mst. Paras daughter of Asadullah Korai, copy of such statement has been placed on record,
wherein she has stated that she has not been abducted by any one and she has
contracted marriage with petitioner No.2 Shaban Ali
out of her free will, without any pressure or coercion and has not been
abducted, whereas F.I.R registered by her father, contains false and frivolous
allegations. It has been further stated that she is living with her husband
happily and has not been abducted by any one, the petitioners who are present in
Court verify such position and submits that protection may be provided to them
in accordance with law.
Learned counsel for the
petitioner in view of said statement of Paras,
submits that proceedings in the aforesaid F.I.R may be quashed.
Learned A.A.G submits
that Investigating Officer present in Court, may be
directed to submit report alognwith statement of Mst. Paras before concerned
Magistrate, for disposal of aforesaid F.I.R in ‘C’ Class.
Accordingly instant
petition stands disposed of with directions to Investigating Officer of
aforesaid F.I.R to submit report before the learned trial Court for disposal of
case in ‘C’ class, whereas the concerned Magistrate shall pass appropriate
orders on the report submitted by Investigating officer, who shall submit
compliance report to this Court through Additional Registrar of this Court,
whereas concerned police is directed to give protection to petitioners and to
ensure that no harassment shall be caused to the petitioners.
Petition stands disposed
