Through listed application, learned counsel for petitioners in view of statement dated 15.01.2014 executed between the petitioners and respondents No.7 and 8, does not press instant petition, as according to learned counsel for petitioners, grievance of the petitioners has been redressed in view of the agreement executed between petitioners and respondents No.7 and 8.

Conversely, learned counsel for respondents No.7 and 8 does not controvert such position.

Accordingly, instant petition is dismissed in terms of agreement dated 15.1.2014, however, dismissal of instant petition will not prevent the official respondents i.e respondents No.2 and 3 of Sindh Building Control Authority Sukkur, who are directed to ensure that impugned construction is being raised as per approved plan strictly in accordance with law, whereas in case of any violation, appropriate action may be taken as per rules, after providing opportunity of being heard.
