Statements has been
filed by respondent No. 3 , wherein it has been stated
that neither the police has arrested the
detenue nor detained alleged detenue Jalaluddin Lund.
Statement has also been filed by S.H.O Police Station Khenjoo
along with annexures, wherein it has been stated that petitioner’s husband is involved
in more than 23 cases of different police stations of district Ghotki and district Rahimyar Khan
(Punjab), are registered against Jalaluddin Lund, who
has not been illegally detained by the police, on the contrary he has been
arrested in Crime No. 25/2016 under section 324, 353 PPC, Crime No. 26/2016
under section 24 of Sindh Arms Act, Crime No. 29/2016 under section 3/5
Explosive Substance Act, 7 ATA of Police Station Khenjo
district Ghotki and is under police custody remand.
In view of such factual
position, the purpose of filing the instant petition is served out, however, the petitioner may approach the appropriate
forum for redressal of his grievance.
Accordingly, instant petition is disposed of
along with listed application.
