Mr. Shehiryar Ali Awan, Asstt: A.G. along with Ahmed Ali S.H.O of P.S Hallani.

Pursuant to Court directions, S.S.P Khairpur has submitted detailed report, which reads as under:-

“ After thorough probe, examination of witnesses, perusal of record open and secret enquiry, the undersigned has reached on the conclusion that the contents of Para No.4,5 ,6 and 8 of petition could not substantiated, as on the alleged date and time of offence i.e 31.10.2015 at 5.00 a.m the respondent No.4 Faiz Muhammad Pirzado was in Hyderabad.

That the abduction and appearance of both the abductees was a well planned drama to lodge a false case against the respondents. No evidence of involvement of any of the respondents has appeared before the undersigned.”

Concerned SH.O has filed statement, which is taken on record.

Learned A.A.G has also placed on record order dated 01.03.2016 passed in Crl.Misc. A.No.S-574 of 2015 which reflects that similar grievance was agitated before learned single Judge, whereas it has come on record that alleged detenue has voluntarily appeared before the concerned police on 26.02.2016 and was produced before Sessions Judge on 27.02.2016.

In view of hereinabove facts and circumstances, we do not find any error in the order passed by justice of peace, Accordingly instant petition which is misconceived is hereby dismissed.
