Petitioner and his counsel called absent, no intimation received.

Instant petition was filed by the petitioner on 02.03.2012 seeking
re-investigation of Crime No. 37/2012 registered at Police Station Naushehro Feroze and also release of her husband from illegal custody of the police.

Pursuant to Court notice, ASI Gulzar Ali Mari of P.S. Naushero Feroze and ASI Khadim Hussain KOT Incharge Police Line Naushehro Feroze have shown their appearance and comments have been filed on behalf of respondents No.2 to 4 along with annexures, wherein it has been stated that alleged detenue was arrested in aforesaid crime, whereas case has been challaned before the Court of competent jurisdiction and was not illegally detained by the police.

It appears that in view of hereinabove facts, the petitioner and his counsel have lost interest to proceed with the instant petition, which is pending since 2012, without any useful progress.

Accordingly, instant petition is dismissed; however, the petitioner may seek remedy as per facts and circumstances of the case.
