IN THE HIGH COURT OF SINDH, BENCH AT SUKKUR.

Crl: Transfer Application No.D-  83        of 2015

DATE                                     ORDER WITH SIGNATURE OF HON’BLE JUDGE

FOR KATCHA PESHI.

03rd. November, 2015.

Mr. Mushtaque Ahmed Rind, Advocate for Applicants.

Mr. Noor Hassan Malik, Asstt: A.G.

Through instant criminal transfer application, the applicants have prayed for directions to the learned Incharge Judge Anti-Terrorism Court, NaushahroFeroze to decide the bail after arrest application of the applicants/accused as the Court of learned Anti-Terrorism Court, NaushahroFeroze is presently lying vacant, whereas, according to learned Counsel for the applicants, the learned Sessions Judge, NaushahroFeroze,  is not proceeding to decide the bail application of the applicants in accordance with law.

Learned Counsel for the applicants submits that he will not press his request for seeking transfer of the case and prays that directions may be issued to learned District & Sessions Judge, NaushahroFeroze to decide the bail application of the present applicants at an early date in accordance with law.  It is further contended by learned Counsel that under similar circumstances similar order has been passed by this Court and has placed the copy of order dated 15.10.2015 passed in Criminal Transfer Application No.D- 81 of 2015.

Learned Asstt: A.G present in Court in some other cases, waives notice and extended his no objection for disposal of the instant criminal miscellaneous application in above terms.

There seems no impediment for grant of such request made on behalf of applicants in the instant application. Accordingly, instant criminal miscellaneous application is disposed of with the directions to learned Sessions Judge, NaushahroFeroze to decide the bail application of the present applicants at an early date after providing an opportunity of being heard to the parties, in accordance with law.
