Petitioner and his counsel called absent, no intimation received.

Instant petition was filed by the petitioner regarding wrongful confinement of detenues Waheed and Badar at the hands of respondent No.1 i.e S.H.O P.S Bakhri, district Naushehro Feroze.

Pursuant to Court notice, SIP Syed Munawar Ali Shah has shown appearance and filed statement wherein it has been stated that relatives of petitioner attacked upon couple and committed triple murder, however at the instance of one Ameeruddin F.I.R No.110/2011 under section 302, 34 ,149, 337-H(2) PPC has been registered at Police Station Muhabat Dero.

Learned A.A.G submits that purpose of filing the instant petition has been duly served. No one is in attendance on behalf of petitioner, no intimation received. Instant petition is pending since 2011 without any useful purpose, whereas the petitioner has not remained vigilant to pursue the instant matter.

In view of hereinabove facts and circumstances, as the purpose of filing the instant petition has been served out and it will be futile to keep the matter pending .

Accordingly instant petition is disposed of.
