Learned State counsel submits that
pursuant to Court directions, the necessary postings and transfers have been
made to ensure that rule 14.47 of Police Rules,1934 as
well as order passed by division bench of this Court in
CP
No.D-2314/2011 re: Ajeeb Ali Versus Province of Sindh
and others shall not be violated.
Mr. Alam Sher Bozdar, learned counsel for interveners
submits that he has filed an application on behalf of proposed interveners, who
according to learned counsel, have been transferred from district Ghotki to district Khairpur Mir’s
pursuant to pendency of instant petition, whereas according to learned counsel, the transfer of
proposed interveners is not governed under rule 14.47 of Police Rules,1934.
We are not inclined to entertain the
request of learned counsel for interveners in the instant petition, as it
relates to compliance of rule 14.47 of Police Rules,1934,
according to which, no Inspector or Sub-Inspector can be posted in home
district, whereas, such order has already passed by division bench of this Court
in CP No.D-2314 of 2011 re: Ajeeb Ali versus P.O
Sindh and others .
Accordingly, instant petition is disposed
of along with listed applications , however, with
directions to the respondents to ensure that compliance of aforesaid rule as
well as the order already passed by division bench of this Court, as referred to hereinabove shall be made. However, the proposed interveners
are at liberty to seek remedy against their transfer order in accordance with
law before the appropriate forum or Court of proper jurisdiction.
