Learned counsel for the petitioners,
under instructions, does not press the instant petition, as according to
learned counsel, the election was
scheduled to be held on 14.02.2016, now has been re-scheduled on 22.02.2016,
whereas, the election petition filed before the Election Tribunal is still
pending. Learned counsel for the petitioners submits that the petitioners may
file a fresh petition if the occasion may so arises.
Since we have not heard learned
counsel for the petitioners on merits and as to maintainability of instant
petition, therefore, we simply allow him to withdraw the instant petition,
however, petitioners are at liberty to seek remedy in case of any grievance, in
accordance with law.
Petition
stands dismissed as withdrawn along with listed applications.
