Through instant petition, petitioner has impugned order dated 14.04.2016 passed by Judge Accountability Court, Sukkur, whereby an application filed by the petitioner on 07.03.2016 under section 540 Cr.P.C has been dismissed.

Counsel for the petitioner submits that the application under section 540 Cr.P.C has been dismissed without hearing the petitioner or issuing notice to prosecution.

From perusal of diary sheet dated 14.04.2016 annexed along with this petition, it appears that the petitioner after filing an application under section 540 Cr.P.C did not pursue the same, even failed to attended the Court or make his arguments on such application, therefore, on account of non-prosecution said application has been dismissed. The petitioner instead of having pursued such application, before learned NAB Court has chosen to remain absent and has now filed instant petition. No cogent ground has been pointed out, which may require this Court to interfere in the proceedings already pending before Accountability Court, where evidence of P.Ws has been recorded.

Instant petition along with listed applications is dismissed in limine.
