Learned counsel for petitioner
submits that a civil dispute is pending between the parties in respect of
residential property, however, at the instance of private persons, Wafaqi
Mohtasib (Ombudsman) issued the impugned letter dated 26.07.2012 whereafter the
Deputy Inspector General of Police Sukkur was
directed to dispossess the petitioner from suit property.
Mr. Sajjad
Mohammad Zangejo has shown appearance and filed Vakalatnama on behalf of respondent No.3, and submits that
instant petition has become infructuous, as no action has been taken pursuant
to impugned letter dated 11.6.2012 as another letter dated 26.07.2012 was also
issued from the office of Director General (Incharge)
Wafaqi Mohtasib (Ombudsman)’s Secretariat Regional Office, Karachi, directing
respondent No.3 not to proceed further. Such fact is not disputed by learned
counsel for petitioner, who submits that purpose of filing the instant
petitioner has been achieved as no adverse action has been taken pursuant to
impugned letter as referred to hereinabove.
Be that as it may, instant petition
is disposed of as infructuous, however, without prejudice to any legal right of
entitlement of any party in respect of subject property.
