Through
instant petition, the petitioner has expressed his grievance against the mala
fide of respondent No.5 SHO PS, A-Section, Sukkur, who according to petitioner,
has not shown the arrest of accused namely Yousuf
Khan, the respondent No.9, who is accused of crime No.136/2015 registered at PS
A-Section, Sukkur, in spite of the fact that he was arrested in another FIR
No.194/2010 in which the accused was sent to jail and has been released after
having obtained bail. It has been prayed that inquiry against such SHO may be
directed to be conducted. It has been further stated that such FIR has already
been challaned, whereas, according to learned counsel
for the petitioner, the aforesaid person has been shown as absconder and other
co-accused persons have been arrested.
It
will be appropriate for the petitioner to approach the learned trial Court, who
shall issue directions to the concerned police for the arrest of the accused
nominated in the aforesaid FIR, whereas, as regards allegation of deliberately
having not shown the arrest of accused Yousuf Khan by
the said SHO, such fact may also be brought to the notice of learned trial
Court, who shall pass appropriate order. However, petitioner is at liberty to
file complaint before the concerned police authorities regarding alleged act of
the respondent No.5.
Accordingly,
instant petition being devoid of any merits is dismissed in limine along with
listed applications.
