Petitioners
and their counsel are called absent, no intimation received. Learned counsel
appearing for SEPCO authorities and the learned AAG have raised an objection
with regard to maintainability of instant petition, as according to learned
counsel the petitioners, who are defaulters in payment of electricity dues,
instead of approaching the Electric Inspector regarding disputed bills, have
filed instant petition, which is liable to be dismissed.
Record
shows that after filing instant petition, the petitioners and their counsel
have not remained vigilant to proceed with the matter, which is pending since
2013 without any useful progress. It appears that the petitioner has lost
interest to proceed with the matter, which is accordingly dismissed for
non-prosecution along with listed application. However, we may observe that
petitioners will be at liberty to approach the SEPCO authorities or to file
application before the Electric Inspector in respect of disputed bills in
accordance with law, whereas, the respondents are also directed to ensure that
petitioners may be allowed opportunity to explain their position relating to
disputed bills. However, if the petitioners are defaulters, appropriate action
may be taken against them for recovery of legitimate outstanding electricity
dues.
