               Applicant Mst.Aziza has been produced from Darul Aman Sukkur who has stated that her husband Shabir Ahmed s/o Mehrab has already divorced her by issuing ‘talaqnama’ dated 23.2.2016 therefore she does not want to live in Darul Aman Sukkur  and wants to go with her first cousin and his wife who are present in court.

               Learned counsel submits that father of the applicant has already expired, whereas, her mother has contracted second marriage with a stranger therefore, applicant can not go to reside with her mother and requests that she may be allowed to live and reside with her first cousin Muhammad Hussain and his wife Mst.Wazeran who are present in court and have stated that they will take good care of Mst.Aziza and also willing to execute a bond to this effect.

               In view of hereinabove circumstances of the case and keeping in view the desire of Mst.Aziza, the Incharge Darul Aman Sukkur is directed to release Mst.Aziza whose custody may be handed over to her first cousin Muhammad Hussain and his wife Mst.Wazeran who are present in court, however, subject to their executing a bond to maintain her well, before Incharge Additional Registrar of this court.

               Instant Cr.Misc. application stands disposed of in the above terms.
