C.P.No.S-468 of 2016
For Katcha Peshi
16.05.2016
Mr. Aijaz Ali Jarwar advocate for petitioner.
Mr. Noor Hassan Malik,
Assistant Advocate General.
..................
Pursuant
to Court notice, Mr. Alam Sher
Bozdar has filed vakalatnama as well as statement on behalf of respondent
No.5, whereas, statements have been filed on behalf of respondents Nos.3 and 4,
which are taken on record. Learned counsel for the respondent No.5 submits that
no harassment shall be caused to the petitioner, whereas, the petitioner has
already filed direct complaint against the respondents, which is pending before
Special Prosecutor Anti-Corruption, Sukkur, whereas, no such allegation has
been levelled by the petitioner, who has filed instant petition to pressurize
the respondents. Such fact is disputed by learned counsel for the petitioner,
who submits that since the petitioner has filed direct complaint against the
police officials, therefore, they are causing harassment and there is
likelihood that petitioner will be involved in false criminal cases.
In
view of statement filed on behalf of respondents, instant petition is disposed
of with directions to the concerned police to ensure that no harassment whatsoever
shall be caused to the petitioner and if it is found that the petitioner is
being harassed by the police, appropriate action shall be taken against them,
independent of the proceedings, which are pending before the learned trial
Court in view of direct complaint filed under Section 200 Cr.P.C.
